Australian Dr Kendall-Smith jailed for rejecting Iraq War

DR MALCOLM KENDALL-SMITH is a HERO - this Australian doctor in the British RAF has been jailed for refusing to participate further in the illegal Iraq War.

Dr Kendall-Smith has been decorated for previous tours of duty in Afghanistan and Iraq. He argued that the UK-US-led invasion of Iraq was illegal and "on a par with Nazi Germany" (see the Sydney Morning Herald, 14 April 2006: http://www.smh.com.au/news/world/iraq-protest-officer-jailed/2006/04/14/1144521488045.html ).

International legal experts have indicated that the UK-US-led invasion of Iraq was indeed illegal but the military panel thought otherwise and sentenced Dr Kendall-Smith to 8 months jail and dismissed him from the RAF.

Dr Kendall-Smith, now joins the ranks of other courageous people who have stood up for humanity such as Hugh Thompson, Raoul Wallenberg and Dr Rafil Dhafir – people who are an example to all decent people throughout the world.

US Army helicopter pilot HUGH THOMPSON was a hero who intervened to save Vietnamese civilians from being massacred by US soldiers at My Lai, Vietnam, on 16 March 1968. He subsequently reported the atrocity, this eventually leading to the conviction of Lieutenant William Calley for the massacre of 500 unarmed civilians. This decorated war hero (Purple Heart, Distinguished Flying Cross and Soldier's Medal) died in January 2006 (see: http://www.countercurrents.org/us-polya130106.htm ).

Swedish diplomat RAOUL WALLENBERG was a hero who helped save the lives of thousands of Hungarian Jews from Nazi genocide in 1944. He disappeared after the Red Army liberated Budapest and is believed to have died in the Soviet Gulag system in Siberia. A bust of Raoul Wallenberg at a busy intersection in Melbourne, Australia, is a continuing reminder to Australians of our duty to stand up for humanity (see: http://www.countercurrents.org/us-polya130106.htm ).

DR RAFIL DHAFIR, an Iraqi American medical doctor, was sentenced in 2005 to 22 years imprisonment as a result of sending food and medical supplies to Iraq during the Sanctions period. He is the only Honorary Member of the distinguished Brussells Tribunal humanitarian organization (see: http://www.brusselstribunal.org/Dhafir.htm and http://www.brusselstribunal.org/about.htm ).

Both Dr Dhafir and Dr Kendall-Smith are medical doctors who have been imprisoned in Western democracies (the US and the UK, respectively) for standing up against horrendous abuse of humanity by the West in Iraq. The Nazi analogy adduced by Dr Kendall-Smith in his defence is appropriate. The Nazis killed 1.5 million Jewish children during World War 2. So far, the post-1990 Iraqi infant mortality totals 1.6 million and the post-2003 infant mortality totals 0.4 million - and 90% of these deaths have been AVOIDABLE (latest UN and UNICEF figures; see: http://esa.un.org/unpp/ and http://www.unicef.org/index.html ).

Whether a child dies violently ( from bullet or bombs) or dies non-violently ( from deprivation and malnourishment-exacerbated disease) the end result is the same and the culpability the same. Further, as explicitly set out by the Geneva Conventions, the Occupier is responsible for maintaining the health and lives of the Occupied i.e. the Ruler is responsible for the Ruled (see: http://www.unhchr.ch/html/menu3/b/92.htm).

According to the LATEST, Web-accessible UN Population Division data (see: http://esa.un.org/unpp/ ) and UNICEF data (see: http://www.unicef.org/index.html ), the "under-5 infant deaths per 1,000 births" in oil-rich Iraq versus its impoverished neighbour Syria were 200 vs 170 (1953), 50 vs 44 (1990) and 125 vs 16 (sixteen) (2004) i.e. infant mortality decreased enormously under the brutal dictator Saddam Hussein but increased hugely after 1990 due to Western intervention.

The post-1990 under-5 infant mortality in Iraq under war-criminal UK-US sanctions, bombs and occupation now totals 1.6 million and the post-1990 excess deaths (i.e. avoidable deaths) now total 2.2 million. The 1990-2003 under-5 infant mortality and excess mortality in Iraq under sanctions and bombing totalled 1.2 million and 1.7 million, respectively; the 2003-2006 figures for post-invasion Occupied Iraq are 0.4 million and 0.5 million, respectively. In comparison, the post-invasion under-5 infant mortality and excess deaths in Occupied Afghanistan now total 1.4 million and 1.8 million, respectively (see MWC News: http://mwcnews.net/content/view/5948/26/ ).

The huge under-5 infant mortality in Occupied Iraq and Afghanistan (1,300 infants dying every day, 0.5 million infants dying each year and with 90% of these deaths avoidable) is occurring because of the non-provision by the Occupying UK-US-led Coalition of the life-preserving requisites demanded unequivocally of Occupiers by the Geneva Conventions (see: (http://www.unhchr.ch/html/menu3/b/92.htm). The countries of the UK-US-led Coalition have utterly soiled their reputations through their passive mass murder of infants in Iraq and Afghanistan. It is NOT Dr Malcolm Kendall-Smith and Dr Rafil Dhafir who should be behind bars. Bush, Blair, Rumsfeld, Cheney, Dr Rice (Dr Death), their Coalition confreres and the Mainstream Media bosses should be arraigned before the International Criminal Court for their horrendous crimes against "enemy infants" – for their complicity in the continuing passive mass murder of infants in the Occupied Iraqi and Afghan Territories in gross violation of the Geneva Conventions.

      How do you equate US Army helicopter pilot HUGH THOMPSON and Swedish diplomat RAOUL WALLENBERG with someone (DR MALCOLM KENDALL-SMITH) who refused to follow a legal military order? He may very well be a hero and also decorated for previous tours of duty but the fact remains his dissent in the form of refusal to carry out his duties is a crimes under military law.

        Full throttle: "refusal to carry out LAWFUL duties is a crime under military law" - but International legal experts have declared the Iraq War ILLEGAL and hence the duties requested were UN-LAWFUL.

        Further, "military commands" are subject to the Geneva Conventions to which all the Coalition countries are signatory - that's why Hugh Thompson interposed himself between blood-crazed, massacring US soldiers "following orders" and a dozen terrified Vietnamese civilians.

        Further, the Geneva Conventions make it ABSOLUTELY CLEAR that the Occupiers are obliged to do everything in their power to preserve the health and the lives of their subjects in Occupied countries.         By way of comparison, the "death ratio" of "avoidable enemy infant deaths"/"US COMBAT deaths" in Iraq (post-1990) and Afghanistan (post-2001) now total about 3.0 million/1,500 = 2,000 - HOWEVER the ratio of "murdered Jewish children"/"Axis military deaths"in World War 2 = 1.5 million/5 million = 0.3.

        Nazi soldiers (enemy infant/military "death ratio" 0.3) claimed that they were "only following orders" - a defence rejected by the Nuremberg judges and the Allied war crimes judges in the post-war Far East; the responsible Axis generals were found guilty and hanged.

        Dr Kendall-Smith has courageously dissociated himself from egregious war crimes involving an enemy infant/military "death ratio" of 2000 - and ALL decent people around the world should follow his example.

        Whereas Hugh Thompson risked his life at My Lai, Raoul Wallenberg died imprisoned in the Soviet Gulag, Dr Dhafir is imprisoned for 22 years in the US and Dr Kendall-Smith is imprisoned for 8 months in the UK - all WE have to do as citizens of internally peaceful democracies is (a) INFORM EVERYONE and (b) make sure that we don't vote for, support or indeed have any avoidable dealings with those complicit in the avoidable mass mortality of 3.0 million infants (so far) in the Occupied Iraqi and Afghan Territories.

          They can send all the complaints they care to. The International Criminal Court will toss them into the circular file. The 1991 Iraq ceasefire agreement was just that, a ceasefire, with the resumption of hostilities possible if Iraq didn't meet the agreements demands.

          That was never done in any substantial way by Saddam, thus giving the coalition all the legal basis they needed. Moreover the US was given additional legal basis by the US Congress to act on it's own without UN approval.

          I agree that on present form the International Criminal Court will not act - the ICC has become an accessory after the fact and an international disgrace with cowardly complicity through their craven silence and inaction over the UK-US-Coalition mass murder and passive genocide of nearly 3 million infants in post-hostilities Iraq and Afghanistan.

          US Congress may be able to give the US Administration "legal basis" to do things from a US perspective - but NOT from an international perspective. The US either obeys international law or becomes (and becomes perceived as) a "rogue state"- and ditto the UK.

          The racist Anglo-American Coalition is complicit (so far) in the AVOIDABLE deaths of about 2.7 million under-5 Iraqi and Afghan infants (Iraq post-1990, Afghanistan post-2001).

          This is "state terrorism" on a horrendous scale - grossly outdoing barbaric Muslim-origin "non-state terrorist" atrocities which have violently killed some 5,000 utterly innocent Western civilians over the last 2 decades.

          How many utterly innocent infants does the US-led Coalition have to kill before the world says enough is enough? Once these proto-Nazi, criminal psychopaths start on Iran (as has been widely adumbrated) one fears that with more than twice the victim population there will be more than twice the carnage.

            Odd, were they a "racist" coalition when they interceded on behalf of the Muslims in Serbia a Kosovo? Or was the US "racist" in assisting the millions of Muslims in Indonesia effected by the tsunami?

            And I note you didn't address the Iraqi ceasefire agreement. Not surprising... most that throw around the "illegal war" cannard hardly ever do.

            (1) racist UK-US Coalition - if, at the "lower end" of the scale, it was "racism" preventing an Afro-American from entering a restaurant or an Australian aborigine from entering a bar (commonplace until several decades ago in racist US and racist White Australia, respectively), it is surely "racism" for the Anglo-American Coalition to impose circumstances on non-threatening, wretchedly poor non-Anglo-Celtic conquered countries on the other side of the world that directly lead to the AVOIDABLE death of 2.7 million under-5 year old infants.

            Another way of seeing this is from "enemy child"/military deaths ratios. The Axis forces were clearly "racist" as revealed by their mass murder of Jews (6 million) , Poles (6 million) , Roma (1 million?), Russians & Ukrainians (20 million) and Chinese (35 million) - indeed in the Ardeatine massacre arch-racist and monster Hitler officially set the standard of 10 civilian reprisal deaths for every German soldier killed by Italian partisans. YET the "Jewish children murdered"/Axis military deaths ratio was 0.3 as compared to 2000 (TWO THOUSAND) for the ratio of "enemy infant deaths"/"US combat deaths" in the ME-Central Asia theatre since 1990.

            Neither Kosovo intervention nor post-tsunami humanitarianism (nor their signatures on the Universal declaration of Human Rights and the Geneva Conventions for that matter) can absolve the UK-US Coalition from egregious racist violence on an enormous scale against utterly innocent non-Anglo-Celtic women and children.

            (2) "the Iraq ceasefire" in 1991 was a FRAUD (5 centuries of racist genocide demonstrate that Anglo-American "agreements" are worthless, from the first "agreements" with naive American Indians to their utterly fraudulent signatures on international human rights agreements) - the Iraqis observed the ceasefire but the UK-US Coalition continued bombing (and is STILL bombing) and continued the KILLING (1.6 million post-1990 under-5 Iraqi infant deaths - 90% of them AVOIDABLE).

            In 1945 in Germany and Japan there was a "surrender" followed immediately by security, the rule of law and reconstruction - but racist Anglo-American "political" insistence on MINIMAL Coalition military deaths has meant CONTINUED violence since 1990 in Iraq and since 2001 in Afghanistan leading to post-hostility excess deaths of 2.2 million and 1.8 million, respectively.

            For 5 centuries the British (and thence their American cousins) have been invading, conquering and occupying foreign countries over the dead bodies of millions of women and children - why should these presently democratically-elected racist psychopaths change a "winning game" now?) It has been estimated that the excess mortality associated with genocidal British occupation of India (1747-1947) totalled about 1.5 BILLION.

            However decent people throughout the world CAN do something about it. Peace is the only way but decent people are obliged to (a) INFORM OTHERS and (b) AVOID (when possible) any dealings with those linked to the horrendous, continuing Anglo-American Coalition crimes against women and children (JUST TODAY ALONE 1,200 under-5 year old infants will die AVOIDABLY in the UK-US-occupied Occupied Iraqi and Afghan Territories due to continued Coalition violation of the Geneva Conventions - EVERY 3 DAYS the number of victims of UK-US crimes in Iraq and Afghanistan alone EXCEED the number of victims from the 9/11 atrocity).

            Those who IGNORE, DENY or SUPPORT UK-US Coalition criminal violence are COMPLICIT in crimes resulting (so far) in a death toll about 1,000 (ONE THOUSAND) times greater than that on 9/11 but thanks to racist, lying, holocaust-denying Mainstream Media their ONLY legitimate excuse is that of ordinary Germans in 1945: "We didn't know" - it is up to decent people everywhere to INFORM EVERYONE, to make sure that they DO know.

              Really, a FRAUD, wow who'd a thunk it! Need I remind you the US did abide by it's terms. Iraqi very plainly didn't. (A PDF file of United Nations Resolution #687 signed on 3 April 1991 is here), read it and weep. Then ask yourself why Saddam didn't pay reparations as promised to Kuwait. Ask yourself why all the POW's were not returned. Ask yourself why he was destroying missles that were outside UN mandated ranges shortly before the invasion in 2003. Ask your self why he continued to support for international terrorism by paying families of Palestinian suicide bombers $25,000 dollars (raised to $35,000 just prior to the invasion) in direct violation of the agreement.

              And BTW the bombing you claim continued stopped when the ceasefire was signed. It only resumed in 1992 after a no-fly zone, excluding flights of Iraqi planes, was established in southern Iraq, south of latitude 32 degrees north. And that was the result of Saddam indescriminately killing @!$%#es when they revolted.

              NOTE: As a history teacher.... you'd make a GREAT plumber.

                Re "ceasefires" , "peace" ,"fraud" & "history":

                The UK and the US went to war with "White, Christian" Germany twice last century in WW1 (1914-1918) and WW2 (1939-1945). These horrendous conflicts were essentially FULLY and INSTANTLY terminated by "ceasefires" and "proper peace" followed very shortly thereafter.

                NOT SO in overhwelmingly non-Christian, non-European Iraq & Afghanistan. The racist British Establishment psychopaths have been fighting the (remote, distant, non-imperialist) Afghans for 2 centuries - and are STILL killing Afghan infants to the tune of 359,000 per annum (see: http://www.unicef.org/infobycountry/index.html). The racist British Establishment psychopaths invaded (remote, distant, non-imperialist) Iraq in 1914 and have been killing Iraqis on and off for 9 decades - and are STILL killing Iraqi infants at the rate of 122,000 per annum.

                The commonly accepted "rules of war" stipulate non-involement of innocent civilians and especially women and children. The Geneva Conventions (READ THEM: http://www.unhchr.ch/html/menu3/b/92.htm) also stipulate RAPID NORMALIZING of conditions for civilians EVEN with ongoing war.

                For at least the last 55 years the UK, US and Coalition countries such as Racist White Australia (RWA) have IGNORED the Geneva Conventions. The "excess mortality" associated with US Asian wars (all conducted with RWA involvement and all with UK involvement except for Vietnam) now totals about 18 million. The UK, US and RWA are war criminal rogue states by any reasonable interpretation of international conventions.

                The Nazis indulged in mass murder of Jews, Roma and Slavs, the bombing of cities and use of civilians as "shields" in the crossing of mine fields.

                Because the UK, the US and RWA are "internally-decent democracies", deaths of Allied soldiers are politically sensitive - and accordingly they conduct war in a fashion that minimizes military casualties at the expense of "enemy civilian deaths" in gross violation of the Geneva Conventions.

                UK, US, RWA and other Coalition soldiers go into battle effectively "shielded" by "enemy" infants and mothers - war criminal conduct according to International Law and utterly cowardly and contemptible conduct by "normal" human standards - the UK, US, RWA and other Coalition countries are utterly SOILED by this continuing cowardly, criminal mass murder of infants.

                After the 7/7 London Bombing atrocities that killed some 50 innocent commuters, the RWA Leader of the Opposition Mr Kim Beazley was arguably reasonable in describing the perpetrators as "subhuman filth".

                How then should we describe the Coalition leaders and officials such as Bush, Blair and Dr Rice (Dr Death) COMPLICIT in the post-invasion under-5 infant deaths in the Occupied Iraqi and Afghan Territories that now total 1.8 million?

                IGNORING and DENYING war criminal mass avoidable mortality of utterly innocent civilians simply ensures more of the same - indeed there is wide speculation that the same war criminals are about to do to the infants and mothers of (remote, distant, non-imperialist) IRAN what they are STILL DOING to the infants and mothers of Iraq and Afghanistan.

                "Allomothering" (or "aunt behaviour", care for the infants of other females of the same species) is a fundamental behaviour of Homo sapiens and other social primates. IF THEY ACTUALLY KNEW THE CONSEQUENCES OF THEIR ACTIONS (but mostly don't because of non-reportage by lying, racist Mainstream Media), the roughly 50% of voters EFFECTIVELY supporting the Bush Wars that are FEMALE are VIOLATING not only "enemy" infants and mothers but also a fundamental, hard-wired PRIMATE IMPERATIVE - "sub-primate" behaviour?

                It would be interesting to hear the comments of WOMEN about the ongoing Coalition passive murder of 0.5 million "enemy infants" each year (1,300 each day) (just see the UNICEF-reported figures numbers: http://www.unicef.org/infobycountry/index.html).
